Are there exceptions to the reproduction right?

Yes, there are several exceptions in which no royalties are due:

  • For promoting or announcing an exhibition (posters, roll-ups, flyers, publicity), provided that only the poster of the exhibition is used and the following conditions are met:
    • The original work must be present at the exhibition.
    • The location and date of the event must be clearly indicated on the medium.
  • For a current affairs report: if the article relates directly to the work of art mentioned.
  • For a parody, pastiche, caricature: for these uses, the conditions are strictly applied.

 

Mind you, even if a medium is covered by the exception and you don’t have to pay any royalties, you may in some cases have to contact the artist for permission (i.e. moral rights):

  • if the work is overprinted;
  • if the work is incomplete;
  • if the work is linked to politics and/or religion;
  • etc.
