Which artworks qualify for the resale right?
Any original artwork may qualify for the resale right. Article XI.175, §1 of the Belgian Code of Economic Law states:
“For the purposes of this section, an ‘original work of art’ means a work of graphic or visual art, such as pictures, collages, paintings, drawings, engravings, prints, lithographs, sculptures, tapestries, ceramic works, glassworks and photographs, provided that the work is the artist’s own creation or is considered to be an original work of art. Copies of works of art covered by this section that have been made in limited numbers by the artist or under the artist’s authority shall be regarded as original works of art within the meaning of this section. Such copies are generally numbered, signed or otherwise authenticated by the artist.”
