What is freedom of panorama?

Freedom of panorama means that you can take and distribute photographs of copyrighted three‑dimensional works (e.g. sculptures and buildings) which are permanently located in a public place without the permission of the rightholders.

In two cases, you still have to ask the rightholders for permission in advance:

  • If you want to use the photographs for commercial or advertising purposes.
  • If you make a drawing, painting or other graphic adaptation of the original work (because there is no reproduction or communication to the public in that case).
  • Dans ce cas-là, il n’est pas question d’une reproduction ou d’une communication publique.
